Please read these Terms of Service ("Terms") carefully before using Binge Senpai. These Terms constitute a legally binding agreement between you and Binge Senpai ("Binge Senpai," "we," "us," or "our") governing your access to and use of the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies referenced herein. If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, registered users, API consumers, team members, and any other person who accesses the Service in any capacity.
Age requirement: You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years of age. We do not knowingly permit anyone under 18 to use the Service. If we discover that a user is under 18, we will terminate their account and delete their personal data.
Incorporated documents: The following documents are incorporated into these Terms by reference and form part of the agreement between you and Binge Senpai:

2. Definitions
In these Terms:
- "Service" means the Binge Senpai website at https://bingesenpai.com, including the progressive web app (PWA), native mobile app wrappers (iOS and Android), the Binge Senpai Chrome Extension, and the Binge Senpai API.
- "Account" means your registered personal or team account on the Service.
- "AI Features" means the Senpai chat assistant, personalized appeals, AI-generated review summaries, AI-generated recommendation summaries, and any other feature that uses artificial intelligence or machine learning to generate content.
- "AI-Generated Content" means any text, recommendations, summaries, or other output produced by AI Features.
- "API" means the Binge Senpai application programming interface that allows programmatic access to certain Service functions.
- "API Token" means the authentication credential you create to access the API.
- "Chrome Extension" means the Binge Senpai browser extension for Google Chrome used to export data from third-party platforms.
- "Collections" means user-curated lists of anime and manga entries, including system collections (Favorites, Watchlist, Set Aside) and custom collections you create.
- "Content Database" means the anime and manga information catalog maintained by us, including titles, synopses, episode data, character information, staff credits, studio information, and associated images and metadata.
- "Conversation Data" means the messages, prompts, and responses exchanged between you and the Senpai AI assistant.
- "NSFW Content" means anime and manga entries rated R-X (mature/adult) that are hidden by default and accessible only through the content filter toggle.
- "Personal Account" means an individual user account not associated with a team.
- "Team Account" means an organizational account that allows multiple users to collaborate under a shared team identity, with assigned roles (Admin or Member).
- "Third-Party Content" means any content displayed on the Service that originates from external sources, including anime/manga metadata, cover art, trailers, external links, and community data.
- "User Data" means the information you create within the Service, including library entries, scores, progress tracking, collections, favorites, conversation history, and any other data associated with your account.
- "You" or "user" means the individual accessing or using the Service, or the legal entity on whose behalf such individual acts.
3. Account Registration and Security
3.1 Registration
To access most features of the Service, you must create an account by providing your name, a valid email address, and a password. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your information to keep it accurate and current.
- Maintain only one personal account. Creating multiple accounts to circumvent restrictions, manipulate features, or evade enforcement actions is prohibited.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to:
- Choose a strong password (minimum 6 characters) and keep it confidential.
- Enable two-factor authentication (2FA) for enhanced security where you deem appropriate. If you enable 2FA, you are responsible for securely storing your backup recovery codes.
- Notify us immediately at [email protected] if you suspect any unauthorized access to your account.
- Not share your account credentials with any other person.
3.3 Bot Protection
We use Cloudflare Turnstile (including invisible mode) to protect the Service from automated abuse. By using the Service, you acknowledge that Cloudflare may process certain browser and device data for bot detection purposes as described in our Privacy Policy.
4. Account Deletion and Data Portability
4.1 Your Right to Delete Your Account
You may delete your account at any time through the account settings page. Account deletion is also available within our mobile applications. Upon account deletion:
- Your personal data, library entries, collections, favorites, AI conversation history, API tokens, 2FA credentials, and associated data will be permanently deleted from our active systems within 30 days.
- Residual copies may persist in encrypted backups for a limited period consistent with our backup rotation schedule, as described in our Privacy Policy.
- If you are a member of a Team Account, your membership will be removed, but the team itself will not be affected.
- If you are the sole owner of a Team Account, you must transfer ownership or dissolve the team before deleting your personal account.
4.2 Data Portability
You have the right to request an export of your User Data in a structured, commonly used, machine-readable format. To request a data export, contact [email protected]. We will fulfill your request within the timeframes specified in our Privacy Policy.
For users in Mexico, data portability rights are further described in the ARCO rights section of our Privacy Policy. For users in the European Economic Area, these rights are provided under GDPR Article 20.
5. AI Features and the Senpai Chat Assistant
5.1 Nature of AI Features
Senpai is an artificial intelligence system, not a human. When you use the "Chat with Senpai" feature, you are interacting with an AI chatbot powered by Claude (created by Anthropic, PBC) accessed through OpenRouter, Inc. This disclosure is provided in accordance with the EU AI Act Article 50(1).
Senpai has access to tools that allow it to search our content database, view your library and profile, and — at your direction — add or modify entries in your library. When Senpai modifies your library, it does so based on its interpretation of your instructions.
5.2 Accuracy and Reliability
AI-Generated Content may contain inaccuracies, including material inaccuracies that may appear plausible. You acknowledge and agree that:
- AI-Generated Content is provided for informational and entertainment purposes only and should not be relied upon as a sole source of truth.
- AI responses may be incomplete, incorrect, or inconsistent. You should independently verify any information that is important to you.
- We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-Generated Content.
- AI Features may occasionally produce unexpected, irrelevant, or inappropriate responses despite our safety measures.
5.3 Library Modifications by Senpai
Senpai can modify your library entries (add titles, change statuses, update scores and progress) when you instruct it to do so through conversation. You acknowledge that:
- You are responsible for reviewing any changes Senpai makes to your library.
- Senpai may occasionally misinterpret your instructions and make changes you did not intend. You can undo any changes manually through the library management interface.
- We are not liable for any unintended modifications to your library data resulting from AI interpretation of your instructions.
5.4 Conversation Data
Your Conversation Data is stored on our servers and processed by third-party AI providers as described in our Privacy Policy. You may star, rename, and delete individual conversations at any time. Deleted conversations are permanently removed from our systems, with sub-processor copies purged within their stated retention periods.
5.5 Prohibited Uses of AI Features
You agree not to use AI Features to:
- Generate, request, or attempt to elicit harmful, illegal, abusive, harassing, defamatory, or discriminatory content.
- Attempt to circumvent AI safety measures, content filters, or usage restrictions.
- Reverse engineer, extract model weights, or probe the underlying AI model.
- Systematically extract AI responses for the purpose of building competing services or training other AI systems.
- Submit content that violates any third party's intellectual property rights.
- Impersonate another person or entity in conversations with Senpai.
- Use AI Features in any way that violates Anthropic's Acceptable Use Policy or OpenRouter's terms of service.
Violation of these restrictions may result in temporary or permanent suspension of your access to AI Features or your entire account.
6. AI-Generated Content
6.1 Scope
The following content on the Service is generated by artificial intelligence and is labeled as such:
- Personalized appeals — "Why you should watch this" messages tailored to your library history.
- Review summaries — AI-generated summaries of community reviews.
- Recommendation summaries — AI-generated explanations of user recommendations.
- Senpai chat responses — All messages from the Senpai AI assistant.
6.2 Intellectual Property Status
AI-Generated Content may not be eligible for copyright protection under applicable law. Courts in multiple jurisdictions have held that AI-generated works without human authorship do not qualify for copyright registration. Accordingly:
- We do not claim copyright ownership over AI-Generated Content produced for you.
- We make no representation that AI-Generated Content is protectable under intellectual property law.
- You use AI-Generated Content at your own risk and should not rely on it being legally protected as original creative work.
6.3 Labeling
AI-Generated Content on the Service is identified through visual labels (such as "AI-generated" badges or similar indicators). In compliance with the EU AI Act Article 50(2), we will mark AI-generated text content in a machine-readable format where technically feasible.
7. User Data and Library Management
7.1 Your Data, Your Ownership
You retain ownership of your User Data — including your library entries, scores, progress tracking, collections, favorites, and conversation history. We do not claim ownership over data you create within the Service.
7.2 License Grant to Binge Senpai
By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Data solely for the purposes of:
- Operating and providing the Service to you.
- Generating personalized recommendations, appeals, and other AI-powered features based on your library and preferences.
- Producing aggregate, anonymized statistics (e.g., community popularity rankings, genre trends) that do not identify you individually.
This license terminates when you delete your account or the relevant data, subject to our retention periods described in the Privacy Policy.
7.3 Collections
Collections you create — including custom named collections and your use of system collections (Favorites, Watchlist, Set Aside) — are part of your User Data. The organizational structure and curation of your collections is yours. We may display aggregate collection statistics (e.g., most-collected titles) without identifying individual users.
8. Data Import from Third-Party Services
8.1 Supported Imports
The Service allows you to import anime and manga tracking data from:
- Crunchyroll — via JSON export files (using the Binge Senpai Chrome Extension or Crunchyroll's export tools).
- MyAnimeList — via XML export files generated by MyAnimeList's built-in export feature.
8.2 Your Representations and Warranties
By importing data, you represent and warrant that:
- The data you import is your own data from your own account on the third-party platform.
- You have the right to export and transfer this data. This is consistent with your data portability rights under applicable data protection laws.
- Your use of the import feature does not violate the third-party platform's terms of service to the best of your knowledge.
8.3 Import Processing
Imported data is processed using automated matching algorithms to map entries to our content database. This process may involve multi-season splitting, conflict resolution, and approximate title matching. We make reasonable efforts to ensure accuracy but:
- We do not guarantee that all imported entries will be correctly matched.
- Some entries may not be found in our database and will be flagged as unmatched.
- You are responsible for reviewing your library after import and correcting any inaccuracies.
8.4 Imported Custom Lists
Custom lists from Crunchyroll exports are automatically imported as Collections within Binge Senpai. These become part of your User Data and are governed by the same terms.
9. Team Accounts
9.1 Creation and Administration
You may create a Team Account by providing a team name and optionally an avatar. The creator of a Team Account is its initial Owner. Owners have full administrative privileges, including inviting and removing members, assigning roles, and transferring ownership.
9.2 Roles and Responsibilities
- Admins can view member names, email addresses, and roles. Admins are responsible for ensuring that all team members comply with these Terms.
- Members must individually agree to these Terms upon joining a team. Each member's personal library, AI conversations, and favorites remain private to their Personal Account.
9.3 Data and Departure
- If a member leaves or is removed from a team, their personal data remains with their Personal Account.
- Team-level data (team name, avatar, membership history for audit purposes) is retained with the Team Account.
9.4 Ownership Transfer
Team ownership may be transferred to another Admin with the consent of both parties. If a team Owner deletes their personal account without transferring ownership, the team may be dissolved or transferred to the next Admin at our discretion.
9.5 Liability
Team Owners and Admins are responsible for the activities of their team members to the extent those activities are conducted through the Team Account. We may suspend or terminate a Team Account if any team member violates these Terms.
10. API Access and Tokens
10.1 Token Creation and Security
You may create named API Tokens for programmatic access to the Service. API Tokens are displayed once at creation — we store only a cryptographic hash and cannot recover the plaintext token. You are solely responsible for:
- Keeping your API Tokens secure and confidential.
- All activity conducted using your API Tokens.
- Immediately revoking any token you believe has been compromised and notifying us at [email protected].
10.2 Acceptable API Use
When using the API, you agree to:
- Respect rate limits. Exceeding rate limits may result in throttling, temporary suspension, or token revocation.
- Not redistribute, sell, or share API Tokens with third parties.
- Not use the API to build a substantially similar or competing service.
- Not use the API to systematically scrape, harvest, or bulk-download our Content Database.
- Identify your application with a descriptive User-Agent string.
10.3 API Availability
The API is provided "as available." We reserve the right to modify, deprecate, or discontinue API endpoints at any time. We will make reasonable efforts to provide advance notice of breaking changes, but we do not guarantee backwards compatibility.
10.4 Enforcement
API misuse will result in graduated enforcement: warning → rate limiting → temporary token suspension → permanent token revocation → account suspension. We reserve the right to skip enforcement steps for severe violations.
11. Chrome Extension
The Binge Senpai Chrome Extension facilitates exporting your tracking data from supported third-party platforms (currently Crunchyroll) for import into Binge Senpai. By installing and using the Chrome Extension:
- You acknowledge that the extension accesses your data on the third-party platform locally within your browser. Your third-party platform credentials are not transmitted to Binge Senpai.
- You are responsible for ensuring that your use of the extension complies with the third-party platform's terms of service.
- The extension is designed to access only your own account data for the purpose of data portability. Using the extension to access or export other users' data is prohibited.
- Third-party platform changes may cause the extension to malfunction or cease working. We will make reasonable efforts to update the extension but do not guarantee uninterrupted functionality.
- The extension's data handling practices are described in its Chrome Web Store listing and our Privacy Policy.
12. Mature Content (NSFW)
12.1 Age Verification
By default, the Service displays content rated G through R+. Access to NSFW content (rated R-X) requires you to:
- Affirmatively enable the NSFW content filter through the toggle in the navigation.
- Confirm through our age verification dialog that you are at least 18 years old.
Your NSFW preference is stored in your browser session and resets when you log out.
12.2 Tracking Metadata, Not Content Hosting
Binge Senpai is an anime and manga tracking and discovery platform. We display metadata about anime and manga titles (titles, synopses, cover art, episode information, ratings) for informational and cataloging purposes. We do not host, stream, or distribute the actual anime or manga content itself. Links to external streaming platforms or reading sources are provided for your convenience.
12.3 Your Responsibilities
You are solely responsible for ensuring that accessing mature-rated anime/manga metadata complies with the laws of your jurisdiction. We reserve the right to implement geographic restrictions or additional age verification measures as required by applicable law.
13. Third-Party Content and External Links
13.1 Content Database
Our Content Database of 40,000+ anime and manga titles aggregates metadata from multiple sources. This metadata — including titles, synopses, episode lists, character and staff information, genres, ratings, and cover art — is compiled and displayed for informational and cataloging purposes.
Cover art and promotional images are displayed in reduced resolution for identification and reference purposes, in a manner consistent with industry practice among anime and manga tracking platforms. All rights to such images remain with their respective rights holders.
13.2 Videos and Trailers
The Service may embed or link to videos from YouTube and other platforms. Such embeds are governed by the respective platform's terms of service (including the YouTube Terms of Service). We do not host video content.
13.3 Community Reviews and Recommendations
The Service may display community reviews and user-generated recommendations sourced from external platforms. This content is provided for informational purposes. We do not verify, endorse, or guarantee the accuracy of community-contributed content.
13.4 External Links
The Service contains links to third-party websites, including anime streaming platforms, databases, and information resources. We have no control over the content, availability, privacy practices, or terms of these external sites. Clicking an external link takes you outside the Service, and your use of those sites is governed by their own terms.
13.5 No Endorsement
The inclusion of any third-party content, link, or reference on the Service does not constitute endorsement, affiliation, or recommendation by Binge Senpai.
14. Intellectual Property
14.1 Binge Senpai's Intellectual Property
The Service — including its design, code, user interface, logos, trademarks, and original content — is owned by or licensed to Binge Senpai and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.
14.2 Third-Party Intellectual Property
Anime and manga titles, character designs, cover art, and related intellectual property belong to their respective rights holders (studios, publishers, authors, artists). Binge Senpai displays this material for informational and cataloging purposes. If you are a rights holder and believe that material on the Service infringes your rights, please see Section 15.
14.3 Your Intellectual Property
You retain ownership of the User Data you create, including the curation and organization of your Collections. The license you grant us (Section 7.2) is limited to operating the Service.
14.4 Database Compilation Rights
The selection, coordination, and arrangement of our Content Database as a whole constitutes an original compilation. Systematic extraction, scraping, or reproduction of a substantial portion of the database is prohibited.
15. Copyright Notice and Takedown
We respect intellectual property rights and respond to valid copyright infringement notices under both Mexico's Federal Copyright Law (Ley Federal del Derecho de Autor, LFDA) and the United States Digital Millennium Copyright Act (DMCA).
15.1 Filing a Takedown Notice
If you believe content on the Service infringes your copyright, please send a written notice to our designated agent with the following information:
- A physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, with sufficient detail for us to locate it (e.g., URL).
- Your contact information (name, address, telephone number, and email).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

15.2 Counter-Notification
If you believe content was removed in error, you may submit a counter-notification including:
- Your physical or electronic signature.
- Identification of the removed material and its prior location.
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number, and consent to the jurisdiction of the applicable courts.
Under Mexico's LFDA, we will restore removed content within 15 business days of receiving a valid counter-notification unless the complainant initiates judicial proceedings.
15.3 Repeat Infringer Policy
We maintain a policy of terminating accounts of users who are repeat copyright infringers, in appropriate circumstances and at our sole discretion.
16. Acceptable Use Policy
You agree not to use the Service to:
16.1 Account Violations
- Create accounts under false or misleading identities.
- Create or maintain multiple accounts to circumvent restrictions.
- Share account credentials or allow others to use your account.
- Access another user's account without authorization.
- Impersonate any person or entity.
16.2 Technical Violations
- Scrape, crawl, or systematically extract content from the Service (except through authorized API access).
- Reverse engineer, decompile, or disassemble any aspect of the Service.
- Circumvent rate limits, authentication mechanisms, or security measures.
- Introduce viruses, malware, or other harmful code.
- Interfere with or disrupt the Service, servers, or networks.
- Use automated tools (bots, scripts) to interact with the Service except through the API with valid tokens.
- Attempt to gain unauthorized access to systems, accounts, or data.
16.3 Content and Behavior Violations
- Use the Service for any illegal purpose.
- Harass, threaten, or intimidate other users.
- Post or transmit content that is defamatory, obscene (beyond the platform's rated content catalog), or infringes on third-party rights.
- Manipulate recommendation or voting systems.
- Use the Service to distribute spam or unsolicited communications.
- Attempt to access NSFW content while under the age of 18.
16.4 Enforcement
Violations may result in graduated enforcement: warning → temporary restriction of specific features → temporary account suspension → permanent account termination. We reserve the right to skip enforcement steps for severe violations or where required by law. We will provide a statement of reasons for any content restriction or account action, as required by applicable law.
17. Push Notifications and Communications
17.1 Push Notifications
The Service offers push notifications through browser, iOS (APNS), and Android (FCM) channels. Push notifications are opt-in only — we will never send push notifications without your explicit consent through the operating system's permission dialog.
You may revoke notification consent at any time through your browser or device settings as described in our Privacy Policy.
17.2 Service Communications
By creating an account, you consent to receive transactional communications necessary for the operation of the Service, including:
- Account verification and password reset emails.
- Security alerts (new login, 2FA changes).
- Material changes to these Terms or the Privacy Policy.
These communications are not marketing and cannot be opted out of while maintaining an account.
17.3 Platform Announcements
We may publish platform announcements about new features, improvements, and updates. These are displayed within the Service and tracked for read status to avoid duplicate display. You may contact us to opt out of non-essential announcement notifications.
18. PWA and Mobile Applications
The Service is available as a Progressive Web App (PWA) installable from your browser, and through native app wrappers for iOS and Android (using Hotwire Native).
18.1 App Store Terms
If you download or access the Service through Apple's App Store or Google Play, you also agree to the applicable app store's terms of service. Apple and Google are third-party beneficiaries of these Terms with respect to their respective mobile applications and have the right to enforce these Terms against you.
18.2 PWA and Offline Functionality
The PWA may cache content locally on your device for improved performance. Cached content may become stale and may not reflect the latest data. You can clear cached data by uninstalling the PWA or clearing your browser storage.
18.3 Account Deletion via App
Account deletion functionality is available within the mobile applications, consistent with our obligations under app store policies.
19. Disclaimers and Limitation of Liability
19.1 Service Provided "As Available"
The Service is provided on an "as available" basis. We make reasonable efforts to maintain availability and functionality but do not guarantee uninterrupted, error-free, or secure operation. The Service is currently provided free of charge, and no service level agreement (SLA) is offered.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of material changes.
19.2 No Professional Advice
The Service provides entertainment and informational content about anime and manga. Nothing on the Service constitutes professional, legal, financial, or medical advice. AI-Generated Content is not a substitute for professional judgment.
19.3 Third-Party Content Disclaimer
We do not guarantee the accuracy, completeness, or timeliness of Third-Party Content displayed on the Service, including anime/manga metadata, ratings, episode schedules, streaming availability, or community reviews. Information may be outdated, incomplete, or incorrect.
19.4 Limitation of Liability
To the maximum extent permitted by applicable law:
- Our aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) $100 USD.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.
Important notice for users in Mexico: Nothing in these Terms limits or excludes our liability in ways prohibited by Mexico's Ley Federal de Protección al Consumidor (LFPC). Your statutory rights under the LFPC — including the right to effective prevention and reparation of damages (Article 1, fraction IV), the right to adequate information (Article 1, fraction III), and access to consumer protection authorities — are not affected by these Terms. Where these Terms conflict with mandatory Mexican consumer protection law, the law prevails.
Important notice for users in the European Union: Nothing in these Terms limits or excludes our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, (c) any liability that cannot be excluded under mandatory EU consumer protection law, including the Consumer Rights Directive (2011/83/EU) and the Unfair Contract Terms Directive (93/13/EEC). EU consumers retain all rights granted by the mandatory provisions of their country of residence.
20. Dispute Resolution
20.1 Informal Resolution
If you have a concern or dispute about the Service, we encourage you to first contact us at [email protected] so we can attempt to resolve the matter informally. We will make good faith efforts to respond within 15 business days.
20.2 For Users in Mexico
As a Mexican consumer, you have the right to file complaints with the Procuraduría Federal del Consumidor (PROFECO) regardless of any dispute resolution clause in these Terms. PROFECO has mandatory jurisdiction over consumer disputes in Mexico.

We will participate in PROFECO conciliation proceedings in accordance with the LFPC.
20.3 For Users in the European Union
EU consumers may bring claims in the courts of their country of residence for disputes arising from these Terms, in accordance with Regulation (EU) No 1215/2012 (Brussels I Recast) and the Rome I Regulation (Article 6). Nothing in these Terms requires EU consumers to submit to exclusive jurisdiction in Mexico or to mandatory arbitration.
Your mandatory consumer protection rights under the laws of your EU Member State of residence are fully preserved, regardless of the governing law clause in these Terms.
20.4 Governing Law
These Terms are governed by and construed in accordance with the laws of Mexico. However, this choice of law does not deprive consumers in other jurisdictions of the protection afforded by the mandatory provisions of their local law, including but not limited to:
- EU consumers: Rome I Regulation, Article 6(2).
- UK consumers: Consumer Rights Act 2015.
- US consumers: applicable state consumer protection statutes.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Binge Senpai and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms or applicable law.
- Your violation of any third party's rights, including intellectual property rights.
- Your misuse of the API, including any damage caused by applications you build using API Tokens.
- Content you submit or import to the Service that infringes third-party rights.
- Your use of the Chrome Extension in violation of third-party terms of service.
For users in Mexico and the EU: This indemnification clause applies only to the extent permitted by mandatory consumer protection law. It does not apply to situations caused by our own negligence, breach, or failure to comply with legal obligations.
22. General Provisions
22.1 Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters (earthquakes, hurricanes, floods), pandemics or epidemics, cyberattacks or distributed denial-of-service attacks, failure of third-party services (hosting providers, CDN, API providers, payment processors), government actions, sanctions, or regulatory changes, internet infrastructure failures, power outages, and acts of war or terrorism.
We will notify you promptly of any force majeure event and make reasonable efforts to mitigate its impact on the Service.
22.2 Suspension and Termination
We may suspend or terminate your access to the Service if:
- You materially breach these Terms and fail to cure the breach within 15 days of written notice (where the breach is curable).
- You commit a serious violation of the Acceptable Use Policy (Section 16), in which case immediate suspension may apply.
- Your account is involved in illegal activity.
- Required by law, court order, or government authority.
Where feasible, we will provide notice and a statement of reasons before or at the time of suspension/termination. You may appeal account actions by contacting [email protected].
Upon termination, your right to use the Service ceases immediately. You may request export of your User Data within 30 days of termination.
22.3 Modifications to These Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' advance notice via email and/or a prominent in-app notice before the changes take effect. For minor changes (typo corrections, clarifications), updated posting on this page is sufficient.
If you disagree with the revised Terms, you may delete your account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
22.4 Severability
If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed. The remaining provisions will continue in full force and effect.
22.5 Waiver
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
22.6 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, with notice to you as provided in Section 22.3.
22.7 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Binge Senpai regarding the Service and supersede all prior agreements, understandings, and negotiations.
22.8 Translation
These Terms may be available in languages other than English. In the event of any conflict or inconsistency between the English version and any translated version, the English version shall prevail, except where prohibited by local law.
22.9 Accessibility
We are committed to making the Service accessible to users with disabilities. The Service implements keyboard navigation, ARIA attributes, focus management, and other accessibility features. If you encounter accessibility barriers, please contact us at [email protected] and we will make reasonable efforts to address them.
22.10 Service Level and Future Changes
The Service is currently provided free of charge. We reserve the right to introduce paid features, tiers, or subscriptions in the future with advance notice. Free features available at the time of any such change may be modified or restricted, but we will provide at least 30 days' notice before materially reducing free-tier functionality.
